How do I know if I have been wrongfully terminated?

On Behalf of | Dec 7, 2017 | Employment Law

Working for a company for any amount of time means that you put a lot of love, sweat, tears and time into your job. No one wants to be let go of a job. People want to leave on their own terms, not when the company says it’s time. A lot of times, being let go can fall under the wrongful termination category. This is when the law comes into play. So, how do you know when you’ve been wrongfully terminated?

You might’ve been terminated illegally if any of the following apply to your situation:

  • Firing as part of sexual harassment
  • The firing violated any state or federal laws against discrimination
  • The firing violated written or oral agreements regarding employment
  • The firing was retaliatory because you filed a complaint of any kind against your employer
  • The firing occurred in violation of labor laws or collective bargaining agreements

If you’ve been fired from your job you likely don’t know how to handle the situation. You are probably going through a host of different emotions, which is understandable. Here are some tips for handling a wrongful termination so you don’t hurt your case:

  • Never take negative actions against the company
  • Ask about your termination, specifically for the reasons
  • Ask to know who it was who requested you be fired
  • Ask to view your personnel file
  • Collect evidence of any promises made by your employer

If you feel you’ve been wrongfully terminated from your job in Manhattan, it’s best to consult with an experienced employment law attorney as soon as possible. You don’t want to waste a single minute when your rights are at stake.
