Leading-Edge Legal Representation

Difference-Making Representation for Professionals Under Investigation or Facing Criminal Charges

Our criminal defense practice at the interdisciplinary law firm Cox Padmore Skolnik & Shakarchy LLP (CPS&S) is focused on aggressive, resourceful defense of professionals accused of corporate or “white collar” financial offenses.

Understanding Forgery And Counterfeiting

Forgery is a charge that most people commonly associate with signing and passing someone else’s checks. However, the charge often comes into play in investigations into corporate wrongdoing as well — in the form of falsification or alteration of various print and electronic documents such as client authorizations for securities trading, insurance claim documents, financial records and a vast range of others.

Similarly, a counterfeiting charge can arise from circumstances other than those involving currency or coins — such as trafficking in counterfeit goods — and many respected businesspeople have been prosecuted for “racketeering,” or RICO violations.

Any allegation of forgery must be taken seriously for its direct criminal consequences alone, as it can be punishable with substantial prison time. For some clients, however, a count of forgery is one of many potential charges arising from an ongoing investigation that could lead to even more serious consequences for an entire business organization.

Simply stated, discovery of one falsified document or misrepresented product has the potential to bring the house down. Related charges of identity theft, mail fraud, wire fraud, securities fraud or other crimes often accompany or follow on a forgery offense.
