Scope creep can quickly derail a construction contract

Construction contracts are set up to ensure that the client and contractor have a mutual understanding of the project. The terms should be set as clearly as possible so there’s no room for misinterpretation. 

Scope creep is one possible issue that can occur during a construction project. This happens when the work outlined in a construction contract gradually expands beyond its original terms. This often occurs without formal approval or additional compensation. It usually starts small: a few extra tasks here or a minor design tweak there. 

Preventing scope creep

Preventing scope creep is one of the most important steps a contractor can take to protect themselves in projects. Every element should be spelled out fully. If anything needs to change with the scope of the project, a change order should be completed. 

A written change order provides the information necessary to amend the original contract. This can include the scope of additional work, cost and time implications. Regular communication can set expectations early and help to keep them on track throughout the duration of the project. 

Addressing scope creep

If scope creep does occur, everything must be addressed swiftly. Contractors should track all the work that’s done outside of the contract terms. Knowing the terms of the contract and the resolution methods that are allowed can be beneficial. 

Letting scope creep go unchecked can lead to contract disputes, payment issues or legal action. By dealing with it proactively and professionally, both parties can protect their interests and keep the project moving forward smoothly.
